本利用規約（以下「本規約」といいます。）は、Nullschool Technologies株式会社（以下「当社」といいます。）が提供するアプリケーション「Nullschool」（以下「本アプリ」といいます。）の利用条件を定めるものです。

本アプリをダウンロード、インストール、または利用することにより、利用者（以下「ユーザー」といいます。）は本規約の内容に同意したものとみなされます。本規約に同意いただけない場合は、本アプリをご利用いただくことはできません。

第1条（Apple標準使用許諾契約との関係）

ユーザーによる本アプリの利用は、Appleの標準使用許諾契約（EULA）（以下「Apple EULA」といいます。）の条件に従うものとします。

本規約は Apple EULA を補完するものであり、両者の内容が矛盾する場合には、アプリのライセンスに関する事項については Apple EULA の定めが優先して適用されます。

第2条（サブスクリプションおよび支払い）

  1. 本アプリは、有料のサブスクリプションサービス（定期購読）を提供する場合があります。
  2. サブスクリプション料金の支払いおよび更新手続きは、すべて Apple の App Store の仕組みに従って行われます。
  3. サブスクリプションは、ユーザーが Apple アカウント設定において自ら解約手続きを行わない限り、自動的に更新されます。
  4. 購入完了後のキャンセル・返金は、Apple のポリシーに従って処理されます。当社はこれに関し、直接の返金対応を行いません。
  5. 当社は、サブスクリプションの価格を引き上げることがあります。新価格の適用日の少なくとも30日前までに、当社は変更理由を説明した事前通知を行います。

第3条（データおよびコンテンツに関する免責事項）

  1. 本アプリは、第三者が提供する気象データ、地理データなどの各種データを利用し、過去、リアルタイム、予測に関する状況を可視化するものです。
  2. 当社は、これらの情報を処理・整理して提供しますが、元となるデータは第三者によって提供されており、当社が運営または管理するものではありません。
  3. 当社は、これらのデータおよび本アプリにより表示される内容について、その正確性、完全性、有用性、適時性等を保証いたしません。
  4. データや可視化結果には、誤差、欠落、遅延、中断等が生じる場合があります。
  5. 本アプリは、情報提供および教育を目的として提供されるものであり、航行、気象判断、防災、緊急対応、その他生命や財産に関わる重要な判断に利用することはできません。
  6. ユーザーは、本アプリおよび本アプリを通じて得られる情報を自己の判断と責任において利用するものとし、当社は、法令に別段の定めがある場合を除き、これらの利用により生じたいかなる損害についても一切の責任を負いません。

第4条（プライバシー）

本アプリの利用に際しては、当社のプライバシーポリシーが適用されます。ユーザーは、本アプリを利用することにより、当該ポリシーに同意したものとみなされます。

第5条（準拠法および管轄裁判所）

本規約の解釈および適用は、日本法を準拠法とします。

本アプリまたは本規約に関して当社とユーザーとの間で生じた紛争については、訴額に応じて東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。

Article 2: Subscriptions and Payments

  1. The App may offer paid subscription services.
  2. All payments and renewal procedures for subscriptions shall be conducted through Apple's App Store system.
  3. Subscriptions will automatically renew unless the User cancels the subscription through their Apple account settings.
  4. Cancellations and refunds after purchase shall be handled in accordance with Apple's policies. The Company does not provide refunds directly.
  5. The Company may increase the price of subscriptions. Advance notice explaining the reasons for the change will be provided by the Company at least 30 days before the new price takes effect.

Article 3: Data and Content Disclaimer

  1. The App utilizes various types of data provided by third parties, including but not limited to weather and geographic data, to visualize historical, real time, and forecast conditions.
  2. The Company processes and organizes this information, but the underlying source data originates from third parties that the Company does not operate or control.
  3. The Company makes no warranty regarding the accuracy, completeness, usefulness, or timeliness of such data or of the content displayed by the App.
  4. The data and visualizations may contain errors, omissions, delays, interruptions, or other inaccuracies.
  5. The App is provided for informational and educational purposes only, and must not be used for navigation, weather-related decision-making, disaster prevention, emergency response, or any other decision-making related to life or property.
  6. Users shall use the App and any information obtained through it at their own discretion and responsibility. Except as otherwise provided by law, the Company shall not be liable for any damages arising from such use or from the provision of the App or its information.

Article 4: Privacy

Use of the App is subject to the Company's Privacy Policy. By using the App, Users are deemed to have agreed to that policy.

Article 5: Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any disputes arising between the Company and the User in connection with the App or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance, depending on the amount in controversy.
